Do you think if there is an issue with my step-mom being an important part of the transfers to her followed by the death bed will of the few remaining assets all to her and as executor, that she should be removed as executor and replaced by someone independent?

Daniel :

Hello and thank you for the question. I am sorry to read of this dilemma.

Daniel :

There is a problem where there are accusations of improper conduct, fraud, and duress.

Daniel :

even with that cloud, one should step aside from acting in a fiduciary capacity to the estate and assets

Daniel :

Is that acceptable?

Customer:

OK so you think a judge would agree? The lawyer acting for her "gave permission" to the lawyer drafting and witnessing both the transfers and the will to release a copy of the will to me after many unsuccessful attempts. Why would lawyer #1 ask lawyer #2 for permission, and why would lawyer #2 give permission? and after all this time 20 months from date of death still be refusing access to the documents?

Daniel :

I do indeed

Daniel :

there should not be permission needed or asked for

Daniel :

Documents should have long ago been provided

Daniel :

without such unreasonable delay!

Daniel :

I wish you the best.

Daniel :

Hope you have a great weekend as well!
