This answer was rated:

Hello!
I am a naturalized US citizen. If I have assets in India and in the United States, in the form of properties and cash, can I write and register 2 seperate WILLS to bequeath my assets to my wife and children who are all US citizens? Seperate WILLS, one for assets in India and the other for assets in the US? Please advise.

INFOLAWYER :

Hello and thank you for the question. I am sorry to read of this dilemma.

INFOLAWYER :

You can have one will covering all property in both countries or you can have one for each country

INFOLAWYER :

either way works

INFOLAWYER :

if you choose to have two wills, each should reference the other.

INFOLAWYER :

Good luck!

INFOLAWYER :

Let me know if that is clear.

Customer:

What is your recommendation taking into account that the US assets are joint assets between my wife and I and the India assets are mine alone. A joint will for US assets and an individual will for India assets?

INFOLAWYER :

I would have 2 wills

INFOLAWYER :

one in each country

INFOLAWYER :

given different manner assets held

Customer:

As I am US citizen, I will have to register them both in the US....correct?

Customer:

And then Notarize, Apostile and Certify at Indian Consulate, for the India Will?

INFOLAWYER :

Yes

INFOLAWYER :

i wish you the best.

Customer:

Can I do both Wills on LegalZoom.com and register in Minnesota?

INFOLAWYER :

I would suggest through local counsel

INFOLAWYER :

I do not recommend form based sites

INFOLAWYER :

martindale.com and findlaw.com are good directories for it

Customer:
