How and when is a copy of a will acceptable in Probate? Must the copy be submitted by an attorney?
Dear JACUSTOMER - A copy of a will cannot be filed by anyone, attorney or no attorney. The only possibility to have a copy of a will admitted would be to have a hearing before the court with testimony from witnesses that the deceased did in fact sign the will and that there have been no subsequent wills executed or that the original was not purposely destroyed. This is a very rare situation that the copy would ever be admitted and if there is anyone contesting the will it is virtually impossible to get a copy admitted.
