I am co-executor of my fathers estate. I have been staying at the residence while cleaning it out and trying to find items for the other executor. Since I have had to do all of the cleanup of the property and have had to maintain said property. Can the other co-executor charge me rent?
Optional Information: State/Country relating to question: Iowa Already Tried: I am just stunned that the attorney representing the estate has decided that I must pay $1000 per month that I have spent there since the death of my father. The co-executor has not assisted with the cleanup or removal of any property
Thank you for using Just Answer. If you require clarification, please feel free to post a follow up question. The estate is entitled to rent for the property. However, you can charge a reasonable fee for the maintenance of the property. You can not take advantage of your position as executor to live rent free in the estate property. That is a violation of your fiduciary duties.
