My neigbor just passed away, leaving no will. How can a fiancee get his house? I liove in Illinois. He has 2 children from previous marriage. She (his fiancee use to live with me) for at least 2 1/2years. Se did not co-habitate for 24-7 in fact a lot of her clothes and dvds personal items are still here. Concerned for the kids!!

Unfortunately unless she was a joint owner of the property, the fiancee would not be able to inherit the home. This is because without a Will directly distribution of the property, the estate passes according to state law, which would be his children.
