when there are two trustee's appointed to handle a trust can one trustee act soley and rent out the property or must the two trustee's be in agreement.
Hello,It would depend entirely on what the trust documents state the designation of power is. If they are listed as co-trustees, then typically they would have to both agree on decisions related to the trust. If they are both designated as trustees, then they could each act independent of each other as long as they were acting under the terms of the trust in fulfilling its directives..But typically one trustee could bind the trust in a rental agreement unless the trust specifically stated that both must be in agreement for any real estate transactions..
