missing estate items
Optional Information: Country relating to Question: United States State (if USA): Pennsylvania Already Tried: asked the execture to produce items, denies knowledge
Thank you for trusting Just Answer. I will answer as clearly as possible. What type of items are you talking about? How long has it been since the executor filed an inventory for the estate?
a painting that could be worth 200k-500k the deceased allways wanted it to be appraised but never did it.the family all knew it was in the house, but now is not availble.to my knowledge no inventory was done.
An Inventory is required in an estate in PA. The executor will be required to file an inventory with the probate court within 9 months of the date of death. This inventory must include all assets. You can check the probate court in the county where the person died to see if an inventory has been filed. The probate court file, including any inventory, is public record and can be viewed and copied by anyone. If there is no inventory and it has been more than 9 months or if the inventory does not list the painting then you can file a petition for removal of the executor for the failure to file an accurate inventory of ALL estate assets. The probate court can remove the executor in this situation. Any new executor that is appointed can search for the missing estate asset.
