I am listed as the 2nd Exc. of my grand fathers will and the 1st has not given us any info as the goings on since his passing in Aug. 2011 do I have any power to check up on him?

Hello,Thank you for allowing us to assist you with this problem.A contingent executor (2nd executor) does not have primary rights to act unlike a co-executor would have primary rights to act. However, if you are an heir to the estate you can request a status of the probate process and if the primary executor does not disclose then you should send a letter to the probate judge requesting that there be an accounting of the estate so you can obtain the information. Legally you should send a motion for an accounting to the probate judge but often a letter will be sufficient.
