my mother died in intestate and my sisters were living w her a the time. they are claiming that they are to be reimbursed for the rent they paid to my mother and for the post death mortgage payments they paid while serving as exec. of her estate. they allowed the home to go into foreclosure and subsequently penalties ( they claim) have reduced the funds to be dispersed to half of what the house was recently sold for( 173,000 ). 83,000 dollars is what the amount being showed for dipersment comes to of which myself and the other sibling are to each recieve 3,600 of, because the other two sibling wish to be reimbursed for what i mentioned ealier. we are in wyoming and i have no idea if there be any merit to their claims?
Without any evidence proving that mom agreed to reimbursed them for their contributions, the sisters are not entitled to anything. At the time when mom was alive the house was not theirs, so mom could legally ask them to pay rent in order to live on the property. As to the mortgage, they were not required to pay it, so anything the paid upfront would be considered a gift, unless there was a written agreement that mom agreed that they be reimbursed. Before the sister's get reimbursed they would have to file a creditor's claim against the estate and would need to present proof that this was owed. Otherwise without evidence, they have no case.
