Our company hired an employee under a 6-month period. Five months into this probationary period, mgt. decided to move employee to a part-time position due to not fully grasping job duties which was approved by the board chairman and personnel comm. chairman. probationary employee accepted the position, then called board chairman complaining of not receiving adequate training. board chairman didn't inform personnel comm that this employee had contacted & then board chairman took upon themselves to order mgt to extend probationary period until end of year. Mgt didn't approve but was lead in the manner "it was to be done"!
Probationary employee complained of inadequate training, as stated above. However, after only 4 hrs of extended training had been completed w/ prob. emp., that emp. signed off on all job duties but 3. After 7 hrs of extended training said emp. signed off on all job duties; however, mgt has documentation of error after error along with 2 customer complaints so far of duties that this emp. has stated they can do successfully. What legal right do I have to release this employee? We aren't under any type of union, etc.
