Customer Question

Hi, I worked for a company A for the end client B and signed a Non-Compete clause for 1year in order to not get engaged with any competition. However upon client B's suggestion, I resigned from company A and joined another vendor Company C to continue work for end client B. The Company A has now sent me a Cease & Desist letter thretening to take legal action. What should I do?

I'm Lucy, and I'd be happy to answer your questions today. I'm sorry to hear about your situation.

Whether a non-compete is enforceable depends upon a few different things:

1. What were the terms of the non-compete with Company A?

2. Was the agreement something you signed when you first accepted the job?

3. What type of work do you do?

4. What state do you live in?

1. Terms are as stated in the query that I would not do business with any competition for 1year.
2. Yes I signed
3. Technical PM
