Unpaid hours must be paid. This is a wage and hour issue and owing under state law and the fair labor standards act.
Second, a case can be pursued for age discrimination. Normally, before suing, a lawyer would reach out, threaten lawsuit, and seek to work out a settlement - which can be faster and cheaper.
