This is indeed discrimination. However, it is not illegal.
Discrimination is only illegal if it is based on race, religion, creed, gender, family, sexual orientation, and whatever else is covered by federal and state law.
Otherwise, it is not illegal
. It simply is not. So the manager has discretion to require to have one person come in while another one working from home, even if the decision is based on favoritism
