We are thinking of implementing a 40 hour guarantee to our employees, due to the unstable schedule we currently have. What legal issues should we be aware of? We want to have qualifying criteria, is that acceptable?

They are all hourly employees and we are going to pay them for 40 hours. If they work 32 hours they will be paid for 40.

I see no risk or problem there. You are potentially paying more than hours worked. If anyone works over 40, need to pay overtime. If you don't offer guarantee you maintain more discretion to pay only for hours worked. I wish you the best. I trust the answer has been helpful. kindly let me know.
