This answer was rated:

my daughter is a school teacher in PA. She recently got engaged and is planning a wedding in florida this coming December. She is also taking classes to get her principal certification. She is being told by the class instructor that a teacher who is pregnant and not married can be fired from her job. Is this true and what is your advice.

INFOLAWYER :

Hello and thank you for the question. I am sorry to read of this dilemma.

INFOLAWYER :

Reviewing the facts now

INFOLAWYER :

There is no basis for this threat

INFOLAWYER :

She may not be discriminated against on this basis.

INFOLAWYER :

Would suggest raising this with HR and principal's office

INFOLAWYER :

so there is a record of the improper threat

INFOLAWYER :

That should suffice, and avoid having to escalate the issue with a local lawyer, the eeoc, the labor board and court

INFOLAWYER :

Should a lawyer be needed to communicate with the above, martindale.com is a great resource

INFOLAWYER :

I hope the answer is clear. Please let me know

Customer:

she just found out that she is about 4 weeks pregnant. are you suggesting she contact her schools HR about this?

INFOLAWYER :

Yes

INFOLAWYER :

if she is concerned that the supervisor may seek to retaliate or take any action

INFOLAWYER :

it is a good idea to have a record

INFOLAWYER :

and put HR on notice of the problem

INFOLAWYER :

often that leads to a meeting with the offending party and the offensive conduct stops

INFOLAWYER :

I wish her the best

INFOLAWYER :

and congrats on the expected new addition to your family
