I have written offer letter effective April 11, 2012 stating that I would get quarterly $6,000 retention bonuses and a $24,000 base pay increase after 1 year. I have not been paid last 2 quarters and did not get pay increase. Question: 1. This is total of $18,000 owed. Can I take to small claims court to get $15,000. 2. I am giving 2 weeks notice. Do they have to pay me the 2 weeks? I am in NJ.Thanks.

Just because your total damages exceeds the small claims amount that doesn't mean you can't go there. You just can't be awarded greater than that amount.2. No, they do not have to pay your notice period. When you give notice, you are legally resigning the moment you give that notice. If they choose to have you continue to work during that time, then they would have to pay for it, but they can ask that you leave the moment you give notice.

1. Yes. I believe that I answered that question. Perhaps I'm confused. Though your damages exceed $15,000 you can still sue there in small claims, with the understanding that you can only receive up to $15,000 in damages.
