The following statement was made in an email to the Director (included as falsifying information) that i report to, the Assistant Vice Chancellor (for whom the report was being compiled), a stewart of the union (I am a member of the same union), the local President of the Union and to Human Resources. "If by not entering false information onto the spreadsheet in order to match the inaccurate numbers that were to be given to Lisa by you and Darlene is what you are referring to as not entering data correctly or accurately then my response would be: I was not aware that should have pretended that the information on the registration form was correct and entered it in order to falsify prospective enrollment numbers. "The statement is false, this person is in a grievance with the Director regarding a written warning that she recieved. I am this persons supervisor. These emails have been going back and forth (I am only cc'ed). I would like some resolution, is this libel?
If there was a reasonable belief that the numbers were false or falsely entered then it is not liable, even if it is not true. Libel (defamation/slander) occurs when someone makes a known false statement about someone else to a third party AND that person suffers some actual damage as a result of the statement. The TRUTH is always an absolute defense to a claim of libel. Also, if the party making the statement does not know it is false when they are making it and they have a reasonable belief or an opinion based upon some articulable facts then they are entitled to express that opinion and it is not libel.
