The following statute provides for the removal by the State Police of records of a 302 Commitment when the Commitment is subsequently determined to have been improper. Since your commitment was ultimatley determined to properly be a 201 you should be able to have the PA State police expunge their report. If the County Court refused to issue the Order directing the State Police to correct their records you have two options. Appeal the State Police Decision to the Commonwealth Court of Pennsylvania. That court has jurisdiction over the administrative actions of the State Police. Or Appeal the County Court decision to Superior Court.
