Hello. My name is XXXXX XXXXX X will be glad to help you.
Are you online with me?
yes I am
Any sexual interactions over the internet are governed by federal law, which recognizes a person to be an adult at the age of 18, so any sexual activity.
Do you have any related follow up questions?
what would a person be charged with?
Depends on the nature of the sexual act, but generally with a federal felony sex crime.
if the person didn't know the age of concent didn't apply thst wouldn't make any diffence
The charge would vary depending on the content, nature and the intent of the offender.
It is a strict liability offense.
Which mean that the only thing that prosecutor has to prove is that the criminal act took place and it would not matter what the defendant thought or knew at the time of the offense.
how much time is for that?
Again, it would depend on specific crime, but the penalties can be up to 5-10 years in prison and a lifetime registration as a sex offender.
because these so many people on those webcam sites if it were to happen on there what would be the chances of police knocking at someones door over a mistake like that?
There is always a chance of criminal prosecution.
In any case if you or someone is in that situation, the best thing to do is not to discuss this matter with anyone and to consult with a local criminal defense attorney and to have this local attorney on a retainer in case if federal or state law enforcement does try to question / arrest you or someone in this situation.
Does this make sense?
my bro has never been arrested or anything im wondering if he's gonna get in trouble
The best thing is for your brother to consult and have a local criminal defense attorney on standby and not to discuss this with anyone, including FBI or Police, without having his local attorney present.
if convicted how long will he serve do you think?
could a lawyer get him out of it ? or is there no chance
It would not be fair for me to try to guess any of that information.
It would depend on many different facts and specific charges that your brother can be potentially be charged with.
However, it is a very serious offense and if your brother is charged with federal sex offense with a minor, he can be potentially looking at years in federal prison and a lifetime registration as a sex offender.
how long would you saw it would take for him to find out if hes gonna be charged?
Keep in mind this information, the ultimate defining clause: "18 U.S.C. § 2422(b) prohibits the use of a computer by an adult to send messages on the Internet to persuade and entice a person under 18 years of age to engage in sexual activity that constitutes a criminal offense."
There is 5 years statute on limitations on such crimes.

so 18 is the legal age
Under federal law, which governs internet communication or any other digital communications, such as exchange of sexually explicit photos
webcam sites have a million guys flashing and such do you personally think the police would seek him out ?
I forgot the name of that site the young people use
I already answered that question, but again, it is possible and many people get arrested simply based on the chat logs with minor, without even having any type of video or photos exchanged.
ok thank you
