Hi,

After the police make an arrest, the prosecutor goes over the evidence with the police and determines what crimes the facts make out. Broadly, burglary is an unauthorized entry onto someone else's premises with an intent to commit a crime once inside. Burglaries are felony offenses. Theft is just a taking of what doesn't belong to you. The value of the stolen items determines how serious the theft offense is.
