1. Possession of marijuana under 50 grams, received probation, was 17 when adjudicated


 


2. As an adult in municipal court on a misdemeanor (disorderly persons) charge for possession of a small amount of marijuana, would this be considered a first offense?

If the possession charge was adjudicated in juvenile court it would not count for purposes of reaching a second offense. The current charge would legally be a first offense. However, the DA can consider the juvenile record in deciding the plea they may offer.
