I am facing a Class C felony theft charge. I worked in retail

This answer was rated:

I am facing a Class C felony theft charge. I worked in retail and was accused of stealing a large amount of merchandise. I was arrested, released on my own recognizance and had an initial court date but the DA never presented the case to the grand jury so the court date never happened. But I got a summons the other day for an arraignment in a couple of weeks. I have no prior record not even a speeding ticket. So I'm wondering what sort of sentence I am looking at.

Welcome to JustAnswer.com

Customer:

yes

Alex Esquire :

I am sorry to hear about this unfortunate situation.

Alex Esquire :

Can you please let me know if you had been officially indicted on this serious felony charge?

Customer:

I think so I got a summons for an arraignment for august 1st

Alex Esquire :

Did you make any admissions or confessed to this crime?

Customer:

Unfortunately, yes, I pretty much admitted to everything in the police report

Customer:

I was very cooperative with the police

Alex Esquire :

That generally works against the defendant in criminal case.

Alex Esquire :

Have you retained an experienced local criminal defense attorney?

Customer:

No. I had an attorney when I was arrested in November but not now

Alex Esquire :

Unfortunately, this is an extremely serious felony charge that does carry a maximum sentence of up to 5 years in prison and a fine of up to $5,000.

Alex Esquire :

Also, a felony conviction would make you loss many civil rights.

Alex Esquire :

Does that make sense?

Customer:

Yes. HOw likely is it I will get the maximum sentence with my clean criminal background?

Alex Esquire :

Not very likely, but you do need to hire an experienced local criminal defense attorney, who would hopefully be able to get your confession thrown out based on some legal technicality and would be able to negotiate a plea deal for you, that would allow you to plead guilty to a lesser charge and to avoid being sentenced to jail / prison.

Alex Esquire :

Does that make sense?

Customer:

Yes thank you.
