I had a court summon today for Simple Assault Domestic Violence. Judge Dismissed the Case but said can be reopened in next 6 months if on further complain. I have to go to India on 18th for Visa Extension stamping will there be any problems

AttyCBradford :

No you shouldn't have any problems unless the case is refiled by then.

AttyCBradford :

Generally if a case is dismissed it is not refiled unless they discover new evidence to support the claim

Customer:

Thanks..Can you help me with Immigration question

AttyCBradford :

sure what is the question?

Customer:

I am going to India on 18th for Visa Stamping

Customer:

Will ther be any issue?

AttyCBradford :

no there won't be any issue regarding that as there is no case open against you

AttyCBradford :

You have to disclose the arrest in DS156 and take certified court dismissal records. You going through a background check when going for a visa depends on if your name gets a hit or not in the database. If you had your finger prints taken, you will possibly get a hit.

Customer:

ok...shall I carry Court Disposition Letter with me and Copy of Police Report

AttyCBradford :

Yes carry both
