I asked a question back in July about my being charged with DUI in Ga. I was charged for hving a legal Rx from a VA hospital. I was put in jail forabout 10 hours then released under R.O., to retun for court at a later date. The case was posponed several time awaiting the results of the blood test taken. I have now received a copy of the results and all test were negitive. Can I request that all copies of my arrest be stricken fron the ecord and the mug shots and fingerprints also be stricke?
Hi,Congratulations! Very good news. Yes, under Georgia law if this matter is dismissed, you can have arrest record, prints and photo expunged, so your record will be clean. You can see the law of your state here. Towards the bottom of the page it will tell you broadly what you would have to do. As you can see, it does not appear that you can just ask for it on your court date and have it granted, but there's no harm in trying. If you have to follow the formal expungement procedure, you could do it yourself and the court clerk may have a form you could use, or you could have your lawyer do it for you.
