In Minnesota. Someone is being investigated for entering someones home and stealing a TV and making unauthorized purchases on their credit card. No official charges have yet been filed and no arrests have been made. Can the victim decide to drop the complaint/charges? Or will the state pursue the charges anyway? Credit card purchases equaled $3400 however the credit card company flagged three of the four transactions and only $200 worth of charges were actually made.
Hello Jacustomer,As no charges have yet been filed, the complainant could go to the police and say that he has changed his mind and that he does not wish to press charges any more. The police do not have to listen to that, but for this case to succeed you would likely have to testify before the grand jury and at trial if it gets that far, for the state to get a conviction. The top count here is a residential burglary, which would have a minimum penalty of 6 months in jail and maximum possible sentence of 20 years in prison. (See Minnesota 609.582), so they will want to take it seriously.Unless this person is a family member or an ex-spouse or romantic partner or ex roommate who may still have a set of keys, the state is likely to talk you out of dropping the charges, but you would definitely have better chance if you try to drop this now with the police than once the case has been filed with the court.Good luck.FranL41105.1073099884
