I certainly understand your concern. The public defender is appointed in open court, based upon the financial situation of the defendant. I am not sure as to why he would say he was employed when he was not but he can explain the basis for his error, the next time he is in court. He can try to contact the office of the public defender ahead of time, to see if he does qualify and if the matter could be, to appoint counsel. Moreover, if there is a bond on him, he can bail out, so he does not have to wait in jail. I am sorry to say but if the PD will not get involved until the 25th, he will just have to wait, which could delay the case.
