if im on first offenders Felony probation in ga right now..10 yrs for theft by deception, and got violated for a misdeamenor dui, what would a likely sentence be..first violation
Optional Information: Country relating to Question: United States State (if USA): Georgia Already Tried: spoke with an attorney
Hello,Thank you for using JA. Since this was not a violation that is directly related to the initial offense that you were put on probation for, I would opine that the judge may give some type of jailtime, possibly a month or less, and then return you to your probation. If it was some other type of theft charge, then it would be much more likely that the judge would revoke and impose the original sentence..But the truth of it is that it is entirely up to the judge as to whether or not to revoke or to impose some lesser penalty for a violation to essentially "get your attention"..This is based on my previous experience as a public defender dealing with this type of situation a few times a week, every week, for over 4 years..
.
Thanks.
