I went on PTI 11/4/10 for disposition by theft, was suppose to be off 11/4/11. Was charged but not convicted (still pending) of domestic violence by my ex-wife 2/28/11. I reported to probation officer with in 24 hours of arrest, but in October when she tried to let me go on good behavior the prosecutor would not let me go until case was heard. Its now 06/30/12, still not heard. Prosecutor wont let me off, and doesn't even want to take in consideration what my probation officer thinks. She wants me off. Can the prosecutor do this? Probation officer knew since 2/29/11 of this charge, why not tell me then he wasn't going to let me finish if I was convicted? (I have never been convicted yet) And if my original sentence max would be 2 yrs no parole, can they hold me in PTI longer than 2 yrs? Can they not let me off of PTI since I have a pending charge of domestic violence on 2/28/11?
I am afraid that since the new arrest was a probation violation, the prosecutor can hold you on probation on the PTI for as long as it takes to get the other trial over and if convicted, because the charge occurred while on PTI they can revoke your probation on that first charge as well. You need to have your attorney file a motion for a speedy trial on the domestic charge to get that case to trial.
