My wife does not claim residence in Mass. she cant get health insurance in Florida. We are residanets of FLORIDA.The reason she wants to call Mass her residance as they cant reject her in Mass. We own both homes together thure a trust.
Good morning,I'm sorry to hear of the situation. For your wife to claim residence in Mass, when clearly your primary residence is in FL, in an attempt to secure a health insurance benefit, would constitute fraud, and is something that she could be criminally charged for. The fact that you and she may own property or a trust in Mass does not make either of your Mass residents. This is an idea that your wife should not follow through with. She could ultimately even be jailed or imprisoned for doing this.I wish you the best in 2012.I understand that you may be disappointed by the Answer you received, as it was not particularly favorable to your situation. Had I been able to provide an Answer which might have given you a successful legal outcome, it would have been my pleasure to do so.You may reply back to me using the Reply to Expert link if you have additional questions; and if you do, I ask that you please keep in mind that I do not know what you may already know or with what you need help, unless you tell me.
