I have another question, in the state of tennessee if someone charged with underage consumption completes a pre-trial intervention program, do they need to petition for expungement or does it automatically drop off their record at age 21?
Hello,Yes, although the pretrial diversion program ends up with the charge dismissed at the end of the probationary period if the defendant complies with all conditions, it does not automatically expunge the charge..It would still show up as a charge that had been dismissed on a person's criminal record. When an expungement is granted, it is as if the offense never happened and the person can legally state that they have never been convicted of a crime..And yes, it is considered a misdemeanor and would stay on a person's criminal record indefinitely unless expunged..
