Hello again,

Your employer would not have committed fraud if they had an honest belief in the information they provided to the State. Just because the Unemployment Commission decides that they will award benefits despite the representations of the employer, does not create a criminal fraud case. There must be a showing of an almost conspiracy level effort at telling an intentional false set of facts.
