No. Theft is against the law and stealing from anyone (even another thief) can still be prosecuted. Whatever money your boss has may belong to the IRS, but it sure doesn't belong to you.

Now, whether he would report you and have you prosecuted if he feels you know too much about him is another matter. But if you dared threaten him with going to the authorities if he reported you, that would also be a separate crime.
