My friend was injured at work. A coworker drove him to the hospital. While at the hospital, a company representative was in his emergency room demanding a breatholizer, blood test, and urine test. The doctor prescribed pain medicine. When the nurse was giving the pain medicine to my friend the company representative told the nurse "No", don't give him any pain medicine - and this is after my friend has a urine test (the results were negative). My question is -- does a company representative have a right to be in a patient's emergency room dictating treatment?
Hello,Thank you for your question.The company representative does not have a right to be in the emergency room with the patient. Nor does the representative have the right to dictate treatment unless he is a physician. If your friend did not consent to the presence of the representative in the room, he may have a HIPAA action against the hospital
