Yes. The act in and of itself is not illegal per se, but it has been charged and found to be neglect of a dependent many times before.

As to whether you should contact the authorities, that is up to you. But unless it is happening right now, they won't be charged. But the police might tell them not to do that, as it endangers the child.

Someone should tell them anyway.
