Based on my previous question - does the person have a criminal record if restitution is made?
Thank you for your question. I am not the same expert that answered your previous question, however, in answer to this question, it depends on how the case is disposed of. If the court says they will drop the charges if you make restitution or do community service or something, and you follow all the requirements, then there would be no conviction on your record. If, on the other hand, they decide to prosecute you fully and you are found guilty of a misdemeanor, that could end up on your record. In either case, if you were charged/arrested, it is possible that this would show up in a criminal background check.

You should seek the advice of a local criminal defense attorney regarding these matters. Many attorneys offer free initial consultations, and those in practice for 1-5 years often have lower fees.
