Criminal charges may be filed to an individual who is accused and has witnesses to say he was not the one that assulted an individual after racial remarks were made

The question is can charges be filed if you have witnesses who say you were not the one who did it? (is that your question?)

As long as the police has at least one person who will say you did it, or some other evidence of guilt, they can ignore your favorable witnesses.. That said you can call those people at trial or pretrial to get a not guilty or the charges dismissed...

Reply to romlawyer's Post: What if the person and the witness were drunk? It sound like a he said she said type of situation. The person that was hit did not see who did it was but the "witness" who is drunk pinpointed a minority, when 3 other people can say that he did not.

They can still arrest if they Chose too.... it would be a bad arrest, but not an illegal arrest....
