if someone was charged with 1st degree felony

Customer Question

if someone was charged with 1st degree felony murder and robbery but was found guilty of a lesser included offence of manslaughter w/a fire arm but was found not guilty of robbery can the manslaughter conviction stand if he was found not guilty of the robbery as a principle and not the actual shooter

Dear Customer:

Yes, that charge would still be able to stand. Under Florida Law the State can consider him equally responsible for a homicide.

why ? if the state said he was responsible for setting up the robbery which he was found not guilty of and the robbery linked him to the murder. during the robbry the guy got shot. they know he didnt shoot him and have no solid evidence he was there they convicted the shooter.

how can he equally responsible for homicide if he's not responsible for the robbery and what are the elements of manslaughter w/ a fire arm
