A freight company that i did not contract with wants to be

Customer Question

a freight company that i did not contract with wants to be paid for making a delivery to my home address one day late and I told him he could not drop it in the street lane of traffic or parking. I paid a stiff delivery charge to the retailer for the merchandise but the will not get involved. The freight company said this bill is my responsibility? Why?
JA: Because real estate law varies from place to place, can you tell me what state this is in?
Customer: California
JA: Has anything been filed or reported?
Customer: No
JA: Anything else you want the lawyer to know before I connect you?
Customer: I had believed that the delivery was coming by FEDX ground and they would have put the delivery in the back yard instead it ended up coming by this freight carrier and they wanted to drop it in the middle of the street

You do not need to pay the bill where the company failed to timely deliver as agreed.

This amounts to a breach of contract and is a defense to payment,

company should be more worried about your filing a consumer complaint than pursuing an account it has not earned.
