While waiting on the traffic light to change, someone�s vehicle was hit, as a result they came over on the opposite side and hit my car. As a result they have totaled my car. I am the primary owner of the car, however my daughter is the secondary and drives the car every day. As a result of the loss, she has lost time from work, and had to pay over 300 dollars for insurance on a rental. How can we get our money back? Is it grounds for a lawsuit against the person who hit our car?

Yes, it is grounds. You may though wish to estimate damages and try to work out a settlement. You can do so in small claims court or through a lawyer on contingency fee basis. I suggest collecting all the evidence including police reports, photos, estimates, employment missed days records to back up the damage computation.
