Kaiser turned down a claim, said i was not covered, accident happened 01-29-2016,
my policy with Kaiser was new, i signed up on 12-29-2015 , they debited my account for first payment on 01-11-2016

As I said in your earlier thread, you need to appeal the denial using the procedure they include, as required by law, int he policy.

If the appeal is unsuccessful then you may be able to sue for bad faith and recover punitive damages and attorney fees if you prevail in showing that the denial of coverage was false and they knew that they were not complying with the terms of the policy, which is what "bad faith" requires.
