I went to a dr appt yesterday and they had an entire record

Customer Question

I went to a dr appt yesterday and they had an entire record of the medications I take. I did not fill anything out for them. I asked where they got this information and they told me my insurance company provided it to them! I did not authorize my o surance company to do this isn't that a hippa violation? I have high mark blue cross

Unfortunately, this would probably not rise to the level of a hipaa violation namely because the dr. is a medical provider who can receive this information and your insurance company has an interest as they are the payor. Furthermore, HIPAA does not really give rise to a civil lawsuit claim, it just has fines for providers who violate it. Any claim would have to be brought under any breach of privacy laws in your state.
