Due to legal paper work issues on some sea containers we had

Customer Question

Due to legal paper work issues on some sea containers we had shipped into Mexico we were unable to clear my them for months. The demurage far exceeds the cost of the outright purchase of the normal cost of the containers. The freight company wants 5 times the value of the containers just in demurage. We want our products but is there anything that protects the buyer such as a cap on what they can l can legally charge. We are willing to buy new containers to replace these used containers

Thank you for your question.

Where was the contract made? Does it have a choice of law provision?

Does it have any time limit or set maximum on demurrage claims?

Does is have a venue provision or an arbitration clause?

Please describe the situation a little more.

This is a complicated issue, as noted here.

Thank you sir, these are some of the same questions I have. I am not thinking we will turn this over to our attorneys in Mexico. Thank you forever your help but this service may not be my best approach. I am going to be cancelling this service.Best Regards
