Sorry - I'm confused. In Texas, are we required to pay the $1,400.00 if the contract says we have to pay whether insurance pays of not?

You have to pay per the contract. If insurance pays, great. If insurance does not, contract controls. If your payment is resulting from a breach by another, then you may demand that party cover that expense.
