I had some items in a pawn shop, the loan ran out on the 14th

This answer was rated:

I had some items in a pawn shop, the loan ran out on the 14th sept, and I called and was told I could come in on the 14th and pay the interest or take the items out. I called to see what time they were open and they told me a man is walking out the door with my items and nothing I can do. The man on the phone was taunting me and very rude. I was told I could come in on the 14th, and he said my last day was 13th at midnight. When I called it would be fine to come in on the 14th. Is there anything I can do?

Daniel :

Hello,

Daniel :

Did they not hold the items as promised?

Daniel :

If so, you may sue the shop in small claims court for the value of the items

Daniel :

if they held it as promised, you would not be able to pursue a claim.

Daniel :

Is that clear?

Daniel :

You can also pursue the agency complaints you filed, which would avoid the cost and time of litigation.

Customer:

what do you mean? Hold the items as promised. Like I said they said I could come in on the 14th and pay and they really ran out on the 13th and was not told that when I called.

Daniel :

They breached the agreement

Daniel :

by selling them early

Daniel :

you can therefore sue the shop

Daniel :

or you may lodge the agency complaints you filed

Daniel :

and you can of course do both

Customer:

On the letter they sent is states before the 14th or they would put them up for auction. When I called a week before the 14th, they told me it would be fine to come in on the 14th. When i called on the 14th to find out what time they close, they said the man walking out the door with my stuff. I did not understand. I was told one thing and they said another.

Daniel :

They lied

Daniel :

and breached the agreement

Daniel :

and therefore you have a claim for breach of contract and fraud

Customer:

the manager of the shop told me I could not do anything, that he crosses all his t's and dots all his i's.

Daniel :

He wants you to back off

Daniel :

he wont admit he made a mistake

Daniel :

so you have the remedies I mentioned above

Daniel :

some of which you have begun!

Daniel :

I wish you the best.

Customer:

Thanks

Daniel :

Very welcome

Daniel :
