Did they not hold the items as promised?
If so, you may sue the shop in small claims court for the value of the items
if they held it as promised, you would not be able to pursue a claim.
Is that clear?
You can also pursue the agency complaints you filed, which would avoid the cost and time of litigation.
what do you mean? Hold the items as promised. Like I said they said I could come in on the 14th and pay and they really ran out on the 13th and was not told that when I called.
They breached the agreement
by selling them early
you can therefore sue the shop
or you may lodge the agency complaints you filed
and you can of course do both
On the letter they sent is states before the 14th or they would put them up for auction. When I called a week before the 14th, they told me it would be fine to come in on the 14th. When i called on the 14th to find out what time they close, they said the man walking out the door with my stuff. I did not understand. I was told one thing and they said another.
and breached the agreement
and therefore you have a claim for breach of contract and fraud
the manager of the shop told me I could not do anything, that he crosses all his t's and dots all his i's.
He wants you to back off
he wont admit he made a mistake
so you have the remedies I mentioned above
some of which you have begun!
I wish you the best.
