My husband passed away last Sept. I ordered a monument, have paid a deposit, and it was installed on July 12, Being out of town on that date I was not present for the stone placement. On my way home on July 15 I went by the cemetery to see the stone. The stone has achip in the black granite surface. The place that sold it tells me the chip was not there when it was installed and they do not think it is their responsibility. I still have an unpaid balance for this monument. I am very unhappy, I did not order a damaged stone. What can I do? LB

INFOLAWYER :

Their conduct is a clear breach

you have a few choices

INFOLAWYER :

you may demand your deposit back and to cancel the contract

INFOLAWYER :

you may also demand they fix or replace the stone

INFOLAWYER :

You may threaten to turn them over to a lawyer, the BBB and civil court

INFOLAWYER :

They should not want to face a complaining widow in any of those venues

INFOLAWYER :

and management will typically reconsider when pressed with such threats and measures

INFOLAWYER :

Be sure to have photos to confirm the condition of the stone
