thank you but the answer just opened up more questions....maybe a couple referrences? sorry im just not satisfied with the answer
do i have a case i could settle in court for maybe a cash compensation?

You may have a case, but it looks like a very difficult one to win. Issues of liability for what happened are extremely complex. You will have to work with a skilled personal injury attorney. If you can't find an attorney who will take your case on a contingency percentage fee, that means that you have a bad case. Attorneys will avoid those like the plague because they don't want to waste their time and money on it. You can certainly file such a suit on your own, but you have little or no chance of winning in court. An out of court settlement offer is possible, but it's more likely that you will have your case thrown out on a technicality.
