Hello and thank you for the question.
You need to have the airbag issue fixed
If you sell it without fixing, you need to disclose it
otherwise risk a breach of contract and concealment of material fact claim
Is that clear?
am very disapppointed in the response. Iasked if I could keep it and drive it myself legally and can I sell it if I properly disclose that they were deployed therefore not there. There is no answer regarding me driving it and nothing about whether I would have potential liability even if I disclosed it. Please respond preferably by phoneXXX-XXX-XXXX. If these questions are not clarified just refund my money/
You may not keep it and drive it in such condition
and you must disclose it if intend to sell
to allow buyer to make due repair
You would have liability if you drive it or sell it without such air bags
Is that clearer?
If you have any follow up, please ask me
As I wrote my question abo ut the legality of driving te car without airbags either from the State or Federal Level wasn't answered. Also I need to know if even if I disclose it and have it notarized, if I sell it will I still have liability issues.
It is not permitted at the state level. If you disclose it in writing, buyer has been put on notice. That is sufficient. Buyer then would have to take steps to install. But you would have taken the proper disclosure steps.
Let me know if the answer is now clear and acceptable.
If I can clarify anything, of course, ask me
What is not permitted at the State level?
not having air bags installed
so I can't drive it myself?
also, federal law prohibits dealers, repair shops, etc. from disabling air bags.
I understand. I would be violating a state law if I fix it and drive it without the airbags replaced?
Practically, and from safety perspective, you should have it done right
There is a lot to lose.
I hope the answer is now clearer and acceptable
sorry about the earlier confusion
Have a nice evening
Kindly rate the answer positively
