Hi,I've been served from a debt collector. I tried to negotiate a reasonable settlement/payment plan but they were not interested (at least not yet). I'm going to answer the summons as a first step. Do I need an attorney to do that, or can I file it myself? This is in the Los Angeles court area. Thanks
Hello and thank you for asking your question. My name is XXXXX XXX I will be assisting you. I'm sorry to hear of your troubles with this creditor.
You can answer on your own without an attorney, but keep in mind that you generally have once chance to raise any defenses you may have. Thus, an attorney can be helpful to make sure you raise any possible defenses at the start and not lose that option.
There are also various motions that may potentially be raised, which is also an attorney can recognize for you at the start of the suit.
Thank you. I don't want to miss any opportunities that I'm not trained to recognize.
