I have been taken to small claims court over a credit card I have not paid. If I don't go to court, they have told me that they can take my car, or what money is in my checking account. I am on Social Security Disability with medical bills and medication that takes most of what I make. I do not have the full amount to pay. No lawyers will talk to me. What do I need to do?
Optional Information: Country relating to Question: United States State (if USA): Alabama Already Tried: Nothing yet. I have no idea what to do. I have anxiety/panic disorder and right now I am at a loss. I call the count clerk and talked to a lady there.
Don't get too rattled this happens all the time.Do you owe money on your car? How much is it worth?
No the car is paid for. It is a 2005 Impala, but has been wrecked several times.
You have an exemption in AL for personal property up to $3000 which likely includes the car. In addition, they can't get your social security check, it is exempt as well. You will want to file an answer, you can get one by going to the clerk of courts where the suit was filed and if they don't have a blank form then ask them for a copy of one from a case where an attorney filed an answer and use it as a guide. They will charge you a couple of dollars for it but that way you know it is right.Don't listen to what the collection agency tells you, they lie. Even if they get a judgment they probably can't collect anything. Just be sure not to put any money in a bank account other than your SS check. If you would like any additional information or have more questions please don’t hesitate to ask but please do so my clicking on the Reply to Expert tab.We work for Positive Ratings, please click on one of the top three ratings or one of the Smile Faces, as this would be appreciated.
