I was Argentina 3 years ago on vacation. I rented a car from Alamo Rental Car in San Rafael, Argentina. Alamo rental car home office is in Flordia. When returned the car Alamo charged me about $3000.00 more than the agreed to rental price. I took the case to the approprate couret in Argentina with the outcome in my favor. The problem is Visa keeps billing me for this amount ever thought I have had over 35 hours telephone conversations with Bank of America. Visa is fulley aware of the court ruling. What are my rights and protection against Visa continualy billing of these unjust charges and can I sue Visa for this unjust billings?
Hello. My name is XXXXX XXXXX X will be happy to answer your question.Did you ever pay the visa bill?
Yes I paid the portion according to the contract. The additional charges I didn't pay.
Thank you for your follow up.Unfortunately, if the visa determined that you are liable to pay this "additional" charges, you would either have to pay them to the visa or file a lawsuit against visa to contest the charges. However, if you have a judgment against Alamo, you will be able to collect the "additional" money that you will pay to visa from Alamo, as if the judgment is against Alamo, it is not enforceable against the Visa.
